Wrongful Termination

Fired for All the Wrong Reasons

At Gwilliam, Ivary, Chiosso, Cavalli & Brewer, we understand the anxiety over the future, the anger and the humiliation that victims of wrongful termination are feeling when they walk through our doors. Most have lost more than just a paycheck. They have lost careers, sources of personal pride and in some cases, the very center of their lives. A serious loss of self-esteem and depression usually follow soon after.

For many, simply getting up and facing the day is an act of courage in itself.

Our wrongful termination practice extends to people in Oakland, the Bay Area, northern California and beyond. Our attorneys have handled numerous wrongful discharge/termination claims over the last 30 years and have successfully helped individuals and small groups of employees recover the financial help they needed to recover and move on with their lives.

Some of these results have come in high-profile cases; some of them have not. All of them have been important to our clients and to us. But to ensure outstanding client service, our lawyers accept only those cases we strongly believe in. It is important to us that we feel our experience and resources can make a real difference.

Keeping our focus squarely on the client, each case we accept is assigned a team that includes one of the firm's partners (someone with anywhere from 25 to 40 years of trial experience), an associate attorney, a paralegal and a secretary. This approach enables us to devote the necessary time and attention to case preparation and research. It also ensures that someone who is familiar with your case will almost always be available to respond to your needs and answer your questions along the way.

Spotlight Case
Plaintiff was employed at the Lawrence Livermore National Laboratory and witnessed serious sexual harassment against a fellow worker. When the lawsuit was filed by the worker, The Plaintiff testified honestly in a deposition about the sexual harassment. The Lab immediately instituted retaliation during and after the deposition and within 2 months fired her. She then proceeded to litigate the case against them for over 8 years before it was finally resolved after 2 long jury trials and an appeal. The first trial resulted in a verdict in her favor of $1 million, although the case was reversed on appeal for a new trial. In the second trial, she obtained a verdict of $2 million plus attorney’s fees and eventually the Lab paid over $6 million for her wrongful termination suit.
